Obama Has Immunity for His Role in Steele Dossier Hoax – HotAir

I suspected that this was the case, and even said so in a recent radio interview. 

But I have been very reluctant to write about it because I am not a lawyer, so I can only use my common sense and layman’s understanding of the law in what must be a very, very complex question. 





But Trump, who certainly has access to excellent legal advice, has just said that Obama has immunity from prosecution for any crimes he may have committed in conspiring to use falsified intelligence to undermine Trump’s presidency, set up a phony impeachment, and perhaps put Trump in jail. 

That makes sense to me–not as a matter of justice, but of Constitutional prudence. Just as the Supreme Court recently ruled on presidential immunity regarding (false) claims of crimes by President Trump, I think that the Court would rule that Obama has immunity from prosecution for crimes committed in the course of his duties as president. 





Politically, I am not even sure that prosecuting Obama would make sense. It would provide a sense of relief and closure for a lot of us who are enraged, but it would also alienate vast numbers of people who voted for both Obama and Trump. Democrats loved the lawfare against Trump, and Trump won partly because nobody else did. 

Ironically, as I said in 2024, Joe Biden should have pardoned Donald Trump and come out looking generous. It implies a crime, but would have made him look magnanimous. I would love to see Trump offer Obama a pardon for all his crimes–it would stick it to him where it hurts. 

Unfortunately, if immunity is in, a pardon is out. 

Their privates should strike up Comey and Brennan as a lesson to all people who would conspire against a political enemy, but the smart thing to do is keep on repeating that Obama was guilty but has immunity. No messy trial that ends with a jury of Democrats exonerating him. 

Let’s face it, the chances a jury in any jurisdiction a trial would happen would exonerate Obama even if he were on tape explaining exactly how he intended to commit a thousand crimes and they had photographic evidence. What matters is the court of public opinion, where we can make progress. A court of law is the place where we would least likely score points, even though the facts are on our side. 





Trump should needle him mercilessly. Keep saying Obama is guilty of horrible crimes, but he can’t be prosecuted because of immunity. 

Make Obama squirm. Keep all the revelations in the news. Splash Obama with all the sewage that comes out of a Comey and Brennan prosecution. 

Whatever happens, Obama will be tarnished by this. Not immediately, but it will hurt. He loves being the savior, and will hate having any history written where he gets tagged with orchestrating a hoax. 

That, I am afraid, is the most justice we will get.
